These Terms of Service govern the use of the Csendes Forma Jelenléte online store and the purchase of products through our website.
By placing an order through our online store, you confirm that you have read and accepted these Terms of Service.

2. About Our Products
Csendes Forma Jelenléte sells handmade sculptures produced in Hungary.
Our sculptures are made using materials including stone and iron.
All products available for purchase are displayed in our online store. We do not currently offer custom-made or personalised sculpture orders.
Because our sculptures are handmade, minor variations in texture, surface, colour, shape, or other visual characteristics may occur. These characteristics may be inherent to the handmade nature of the products and do not necessarily constitute defects.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, prices, and other information displayed in our online store are accurate and up to date.
Colours and visual appearance may vary slightly depending on the customer's device, screen settings, lighting, and the natural characteristics of the materials used.
If a product does not conform to its description, agreed characteristics, or applicable legal requirements, the customer's statutory consumer rights remain unaffected.
4. Prices and VAT
All prices displayed in our online store include applicable VAT unless expressly stated otherwise.
Prices may be displayed in different currencies, including:
• Hungarian forint (HUF)
• Euro (EUR)
• US dollar (USD)
The applicable price and currency for an order will be shown during the purchasing process before the order is submitted.
Delivery charges are displayed separately where applicable.
5. Ordering Products
To place an order, the customer selects the desired product, adds it to the shopping cart, provides the requested information, selects an available payment method, and submits the order through the online checkout process.
Before submitting the order, the customer has the opportunity to review and correct the information entered.
The customer is responsible for ensuring that the information provided during checkout is accurate and complete.
6. Payment
Available payment methods may include Visa, Mastercard, and other payment methods made available through Shopify and our payment service providers.
Payment must be successfully authorised before an order can be processed, unless another payment arrangement is expressly agreed.
The customer will receive order-related information electronically using the contact details provided during checkout.
7. Formation of the Contract
Submitting an order through the online store constitutes the customer's offer to purchase the selected product under the conditions displayed at the time of ordering.
The purchase contract is concluded when the seller accepts the customer's order in accordance with applicable law.
An automatic acknowledgement confirming that an order has been received does not necessarily constitute acceptance of the order where applicable law requires a separate acceptance.
If an order cannot be fulfilled, the seller will inform the customer and any payment already made for the unfulfilled order will be handled in accordance with applicable law.
8. Availability of Products
Our sculptures are sold subject to availability.
If a product shown as available becomes unavailable before the order can be fulfilled, we will inform the customer as soon as reasonably possible.
Where the customer has already paid for an unavailable product and the order cannot be fulfilled, the applicable amount will be refunded in accordance with applicable law.
9. Delivery
We deliver orders within Hungary, to European countries, and to Ukraine.
Orders are delivered using the seller's own delivery service.
Estimated delivery times and applicable delivery fees are described in our Shipping Policy.
Delivery times are estimates and may be affected by circumstances outside our reasonable control.
10. Customer Responsibilities
The customer is responsible for:
• providing accurate delivery and contact information;
• ensuring that the delivery address can receive the order;
• inspecting the product appropriately upon receipt;
• using and caring for the sculpture in accordance with its nature and any applicable care instructions; and
• complying with applicable laws when importing products into their country.
The customer may be responsible for damage caused by improper handling, misuse, modification, improper storage, or other actions attributable to the customer.
Nothing in these Terms limits mandatory statutory consumer rights.
11. Right of Withdrawal
Consumers purchasing online generally have a 14-day right of withdrawal under applicable European Union and Hungarian consumer protection legislation.
The detailed conditions and procedure for exercising this right are set out in our Return & Refund Policy.
The right of withdrawal does not affect any other statutory consumer rights.
Where applicable, mandatory legal exceptions to the right of withdrawal apply.
12. Defective or Non-Conforming Products
If a product is defective, damaged upon delivery, or otherwise does not conform to the purchase contract, the customer may have statutory rights and remedies under applicable consumer protection law.
Depending on the circumstances and applicable law, these remedies may include repair, replacement, price reduction, or refund.

14. Consumer Dispute Resolution

Consumers may have the right to use the competent Hungarian conciliation board (békéltető testület) or other competent consumer dispute resolution bodies available under applicable law.
Nothing in these Terms limits the consumer's statutory right to seek assistance from the competent consumer protection authorities or dispute resolution bodies.
15. Intellectual Property
All content displayed on the Csendes Forma Jelenléte website, including but not limited to photographs, product images, texts, graphics, logos, designs, and other materials, is protected by applicable intellectual property laws unless otherwise stated.
The content may not be copied, reproduced, distributed, modified, published, or commercially exploited without the prior written permission of the rights holder, except where permitted by applicable law.
16. Website Use
Customers may use our website only for lawful purposes.
Users must not:
• interfere with the operation or security of the website;
• attempt to gain unauthorised access to systems or data;
• introduce malicious software or harmful code;
• use the website for fraudulent purposes; or
• reproduce or commercially exploit website content without permission.
We reserve the right to restrict or suspend access where necessary to protect the website, our business, or other users, subject to applicable law.
17. Limitation of Liability
We are responsible for fulfilling our contractual and statutory obligations in accordance with applicable law.

In particular, nothing in these Terms limits mandatory consumer rights or liability that cannot legally be excluded or limited.
18. Force Majeure
We will not be responsible for delays or failures to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, serious transportation disruptions, government measures, war, civil unrest, strikes, or other extraordinary events.
Where such circumstances occur, we will make reasonable efforts to minimise their impact and fulfil our obligations as soon as reasonably possible.

We may update these Terms of Service from time to time to reflect changes in our business, website, services, or applicable legal requirements.
The version applicable to an order will generally be the version available and accepted at the time the order is placed, subject to mandatory legal requirements.
The current version of these Terms will be made available on our online store.
20. Applicable Law
These Terms are governed by the laws applicable to the contractual relationship, including applicable Hungarian law and mandatory European Union consumer protection provisions.
Where a consumer is protected by mandatory provisions of the law of the country in which they have their habitual residence, those mandatory protections remain unaffected.
Nothing in these Terms prevents a consumer from exercising rights granted by mandatory applicable law.
21. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force to the extent permitted by applicable law.
